The Drug Enforcement Administration, coordinating with state attorneys general and state pharmacy boards in 14 states, issued cease-and-desist letters to 87 retail establishments selling delta-8 THC products in March 2024.
The action cites DEA's 2021 Interim Final Rule (IFR) clarifying that all synthetically derived tetrahydrocannabinols — including delta-8 THC produced via chemical conversion of hemp-derived CBD — remain Schedule I controlled substances regardless of hemp origin.
DEA's legal theory: delta-8 THC occurs in only trace amounts in cannabis plants. Commercially available delta-8 products are produced through chemical isomerization of CBD (a legal hemp compound). DEA argues this synthesis process renders the resulting delta-8 a synthetic cannabinoid subject to Schedule I, not a naturally occurring hemp compound exempt under the 2018 Farm Bill.
The targeted retailers operate in states that have not enacted state-level bans on delta-8, creating a patchwork enforcement problem. Retailers receiving letters are given 30 days to cease sales or face potential referral to U.S. Attorneys for federal prosecution.
