Cannabis Rescheduling

What Is Cannabis Rescheduling?

Cannabis rescheduling refers to the formal administrative process by which the Drug Enforcement Administration (DEA) and the Department of Health and Human Services (HHS) review and reclassify cannabis under the Controlled Substances Act (CSA). As of 2024, the DEA proposed moving cannabis from Schedule I to Schedule III following an HHS recommendation, the most significant federal drug policy shift in decades.

Schedule I vs. Schedule III

Schedule I substances are defined as having no accepted medical use and a high potential for abuse. Cannabis has been classified Schedule I since 1970, making it legally equivalent to heroin under federal law, limiting research, preventing banking, and imposing Section 280E tax penalties.

Schedule III substances have a moderate to low potential for dependence and an accepted medical use. Examples include ketamine and anabolic steroids. Rescheduling to Schedule III would lift the Section 280E tax burden, facilitate research, and reduce certain federal criminal penalties — but it would not legalize recreational cannabis or automatically allow interstate commerce.

What Rescheduling Would Not Do

  • It would not legalize adult-use cannabis at the federal level
  • It would not resolve banking issues for state-licensed operators (which require the SAFE Banking Act)
  • It would not trigger automatic changes to state laws
  • It would not permit interstate cannabis commerce

Timeline and Process

The rescheduling process involves a Notice of Proposed Rulemaking (NPRM), a public comment period, potential administrative hearings, and final DEA rulemaking. Legal challenges are likely and the process could take years even after a final rule is issued.
