CSA Schedule I

Definition

The most restrictive federal drug classification under the Controlled Substances Act, reserved for substances with no accepted medical use and high abuse potential — including marijuana since 1970.

What Is CSA Schedule I?

Schedule I is the highest-restriction category under the Controlled Substances Act (CSA). Substances classified as Schedule I are deemed to have:

  1. A high potential for abuse
  2. No currently accepted medical use in treatment in the United States
  3. A lack of accepted safety for use under medical supervision

Schedule I includes heroin, LSD, peyote, and marijuana. By contrast, cocaine — a substance with acknowledged medical uses as a topical anesthetic — is classified as Schedule II.

Practical Consequences of Schedule I

For businesses:

  • No federal tax deductions (Section 280E)
  • No access to the federal banking system without regulatory risk
  • No interstate commerce
  • No Small Business Administration loans
  • No federal bankruptcy protection

For researchers:

  • DEA researcher registration required
  • Very limited approved sources (historically only the University of Mississippi)
  • Institutional review board hurdles
  • Schedule I research requires special DEA Schedule I researcher registrations, creating barriers that have significantly limited clinical cannabis research

For individuals:

  • Federal criminal penalties for possession, distribution, and manufacture
  • No lawful federal use, even with a valid state medical card
  • Potential immigration consequences for non-citizens

The Medical Use Paradox

The CSA's Schedule I requirement that a substance have "no currently accepted medical use" is increasingly in tension with reality: the FDA has approved Epidiolex (a plant-derived CBD medication) for epilepsy, and synthetic THC products (Marinol/dronabinol) are Schedule III. Nonetheless, cannabis itself remains Schedule I.
