Delta-8 THC

Definition

A psychoactive cannabinoid found in trace amounts in cannabis, often synthesized from hemp-derived CBD via isomerization; its federal legal status is disputed under the Controlled Substances Act.

What Is Delta-8 THC?

Delta-8 tetrahydrocannabinol (delta-8 THC or Δ8-THC) is a cannabinoid that occurs naturally in cannabis in very low concentrations. Commercially, most delta-8 products are manufactured by chemically converting cannabidiol (CBD) — extracted from hemp — into delta-8 THC through an isomerization process using solvents and acid catalysts.

Psychoactive Properties

Delta-8 THC binds to the same CB1 receptors in the brain as delta-9 THC (the primary intoxicant in cannabis), producing similar but generally described as milder psychoactive effects. Consumers report feelings of euphoria, relaxation, and altered perception.

Federal Legal Status

The legal status of delta-8 THC is contested. The DEA's August 2020 Interim Final Rule stated that synthetically derived THC isomers remain Schedule I controlled substances regardless of their source. However, because the 2018 Farm Bill did not explicitly address THC isomers derived from hemp, a legal ambiguity exists. Multiple federal courts have declined to rule definitively, and the DEA's final rule has not been issued.

State Restrictions

Approximately 20 states have banned or heavily restricted delta-8 THC products, including Colorado, New York, Oregon, and Vermont — states with legal adult-use cannabis markets concerned about an unregulated competitor. Other states have created limited registration frameworks.

Safety Concerns

The FDA has warned consumers about delta-8 THC products, citing risks from manufacturing impurities, inconsistent potency, and lack of safety testing. Poison control centers have reported significant increases in calls related to delta-8 products, including calls involving children.
