Context
Virginia SB 1406 (2023) authorized adult-use cannabis sales and directed the Cannabis Control Authority (CCA) to conduct a lottery for the first cohort of retail licenses with 60% of licenses reserved for social equity applicants. In the 2023 lottery, 250 social equity applicants were selected. Of these, approximately 150 failed to complete the licensing process due to inability to secure compliant retail locations, financing, or both.
Priority Window Details
The CCA announced a 60-day Priority Re-Engagement Window opening November 1, 2025:
Who May Apply
- Social equity applicants selected in the 2023 lottery who received a provisional approval notice but did not complete licensing within the 24-month statutory window
- Applicants must not have had their provisional approval revoked for cause
Benefits
- No application or license fee for initial Priority Window applications
- Expedited review: 30-day review target (vs. standard 90-day)
- Technical assistance: CCA will provide free 1:1 sessions with a cannabis business consultant on site selection, financing, and compliance
Requirements
Applicants must submit, within the 60-day window:
- Updated principal questionnaire (background checks re-run at no charge)
- Signed lease or letter of intent for a compliant retail location
- Evidence of financing sufficient for a 6-month operating runway (business plan + financial statements)
- A 90-day operational readiness plan
Statutory Authority
The Priority Window is implemented under Va. Code § 4.1-631, which grants the CCA discretion to establish expedited pathways for equity applicants facing systemic barriers.
Impact
Virginia's move to reinstate lapsed equity applications is being watched nationally as a model for addressing the "paper license" problem — where equity applicants win lottery slots but cannot capitalize them due to market barriers.
